These Terms of Service ("Terms") govern your access to and use of Peak Predict and its related services, including any content, functionality, and features provided therein (collectively referred to as the "Service"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Account Creation

   1. In order to use certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
   2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Collection and Use of Data

   1. Peak Predict collects and analyzes user recovery and training data to provide feedback on training and recovery behaviors and produce personalized human performance models.
   2. By using the Service, you grant Peak Predict the right to collect, store, process, and analyze your data in accordance with our Privacy Policy.
   3. You agree that Peak Predict may use aggregated and anonymized data for research, analytics, and other purposes in accordance with applicable laws and regulations.

3. User Conduct

   1. You agree not to use the Service for any unlawful or prohibited purpose or in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.
   2. You agree not to upload, post, or transmit any content that is infringing, defamatory, obscene, abusive, offensive, or otherwise violates any law or third-party rights.

4. Intellectual Property

   1. All content, trademarks, service marks, and other intellectual property rights associated with the Service are the property of Peak Predict or its licensors. You agree not to use, reproduce, modify, or distribute any such content without the prior written consent of Peak Predict.

5. Termination

   1. We reserve the right to suspend or terminate your access to the Service at any time for any reason, including, but not limited to, your breach of these Terms.
   2. Upon termination, all licenses and rights granted to you under these Terms will immediately cease, and you must cease all use of the Service.

6. Disclaimer of Warranties

   1. The service is provided on an "as-is" and "as available" basis, without warranties of any kind, either express or implied. Peak Predict disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

   1. To the fullest extent permitted by applicable law, Peak Predict shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or in connection with the service or these terms, even if Peak Predict has been advised of the possibility of such damages.

8. Governing Law

   1. These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

9. Changes to Terms

   1. Peak Predict reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service after the posting of any revised Terms constitutes your acceptance of such changes.
